Terms of Service

These Terms of Service (“Terms”) govern your use of PowerMyWeb (“the Service”), operated by Yihang Huang (“we”, “us”). By creating an account or using the Service you agree to these Terms, which incorporate our Acceptable Use Policy and Refund Policy. If you do not agree, please do not use the Service.

1. What the Service is

PowerMyWeb turns your résumé, GitHub profile, or other career materials into a personal portfolio website generated by artificial intelligence. You can preview, edit, publish the result to a *.powermyweb.com subdomain, and — on paid plans — export it or connect a custom domain.

2. Your account

Some features require an account (sign-in via Google or GitHub). You are responsible for activity under your account and for keeping access to it secure. You must be at least 18 years old (or the age of majority where you live) to use the Service.

3. Your content

  • As between you and us, you retain whatever rights you already hold in the content you upload (your résumé, images, text, links). These Terms do not transfer ownership of your content to us.
  • So that we can actually run the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transform (including processing by our AI provider), transmit, and — for sites you choose to publish — publicly display your content, only as needed to provide, secure, moderate, and support the Service and to comply with law. We may sublicense this only to the service providers named in our Privacy Policy. The license ends when you delete the content or your account, except for residual copies in routine backups and content we must retain for legal reasons. We do not sell your content and we do not use it to train our own AI models; processing by our AI provider is described in the Privacy Policy.
  • You represent that you own or have the necessary rights and permissions for everything you upload, and that the information you publish is accurate. If you upload another person’s materials (for example, preparing a portfolio for a client), you represent that you are legally authorized to do so and have informed them of the processing, hosting, and international transfers described in our Privacy Policy.

4. Generated output

As between you and us, you may use the website generated for you, including commercially, subject to these Terms. We do not represent that generated output is unique, protectable as intellectual property, or non-infringing — similar designs may be generated for other users, and you are responsible for reviewing output (including any third-party material in it) before you publish or rely on it. On the Free plan, published sites include a small “Made with PowerMyWeb” badge that must not be removed; the Pro plan removes it.

AI-generated content can be wrong. You are solely responsible for verifying the accuracy of everything on your site — dates, titles, credentials, project descriptions — before publishing or sharing it.

5. No employment or results guarantee

PowerMyWeb is a website-building tool. It does not provide employment, recruiting, legal, or career advice, and does not guarantee interviews, job offers, client work, website traffic, search-engine ranking, or suitability for any employer or platform.

6. Plans, billing, and cancellation

  • Free: 1 full site generation, 3 conversational edits, publishing to a *.powermyweb.com subdomain with the PowerMyWeb badge. Free sites become read-only 14 days after publishing. Subject to these Terms (including the Acceptable Use Policy and section 12), published Free sites are intended to remain publicly accessible, but permanent hosting is not guaranteed.
  • Pro: $12/month or $96/year. Includes custom domain support, badge removal, HTML export, 2 full regenerations and 40 conversational edits per month. Unused quota does not roll over.
  • Automatic renewal: Pro is a subscription. It renews automatically at the end of each billing period — $12 monthly or $96 yearly, plus any applicable tax — and your payment method is charged at each renewal, until you cancel.
  • Purchases are processed by our merchant of record (the entity named at checkout), which is the seller of record for the transaction and handles payment data, taxes, and invoices. We never receive your full card details. Your purchase is additionally governed by the merchant of record’s checkout terms; for billing matters those terms control, and for use of the Service these Terms control.
  • You can cancel anytime via the manage-subscription link in your account, which takes you to the payment provider’s portal. Cancellation takes effect at the end of the current billing period. On downgrade, custom domains are disconnected, the badge returns, Pro quotas end, and HTML export becomes unavailable; your published *.powermyweb.com site stays up under Free-plan rules. Refunds are covered by our Refund Policy — 30 days, unconditional.

7. Acceptable use and copyright complaints

Your use of the Service and everything you publish through it must follow our Acceptable Use Policy, which includes our copyright-complaint (notice-and-takedown) process. We may unpublish sites or suspend accounts that violate it, and we terminate the accounts of repeat infringers.

8. Subdomains and custom domains

*.powermyweb.com subdomains are licensed to you for your published site, not owned by you. Names are allocated on availability and may be reclaimed or reassigned in cases of infringement, impersonation, abuse, extended inactivity, or legal requirement. Custom domains remain your responsibility — registration, renewal, DNS, and your registrar’s terms.

9. Backups and data loss

PowerMyWeb is not an archival or backup service. Keep your original materials, and export your site when you can. While we take reasonable care, we do not guarantee that content will be preserved, and you should not treat the Service as the only copy of anything important.

10. Service availability and changes

The Service is provided “as is”. We work hard to keep it available but do not guarantee uninterrupted operation. We may change or discontinue features; for material changes that adversely affect paid plans we will give reasonable advance notice, and you may cancel with a prorated refund of any prepaid, undelivered period.

11. Intellectual property

The PowerMyWeb name, logo, product design, and underlying software remain our property. These Terms do not grant you any rights to them beyond using the Service.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy — immediately for dangerous content (phishing, malware, content endangering others). Where practical we will notify you and give you a reasonable window to export your content. If we terminate your paid plan without your fault, we will refund the prepaid, undelivered portion.

13. Indemnification

To the extent permitted by the law of your place of residence, you agree to defend and indemnify us against third-party claims, and associated reasonable legal costs, arising from: (a) content you upload or publish through the Service; (b) your breach of these Terms or the Acceptable Use Policy; or (c) your violation of another person’s rights, including intellectual-property and privacy rights. We will notify you promptly of any such claim and will not settle it on your behalf without your consent. This section does not apply where prohibited by mandatory consumer law.

14. Disclaimer and limitation of liability

To the maximum extent permitted by law: the Service is provided without warranties of any kind; we are not liable for indirect, incidental, or consequential losses (including lost opportunities, lost profits, lost data, or reputational harm); and our total aggregate liability for all claims arising out of the Service is limited to the greater of US$100 or the amounts paid for your subscription to the seller of record in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law — including liability for willful misconduct, gross negligence, or personal injury — or affects statutory rights that cannot be waived.

15. Force majeure

Neither party is liable for delay or failure caused by events beyond its reasonable control (including outages of upstream providers, network restrictions, government action, or natural disasters), provided reasonable efforts are made to mitigate. This does not excuse refunds already owed or our obligations to handle your data lawfully.

16. Governing law and consumer rights

These Terms are governed by the laws of the People’s Republic of China, excluding its conflict-of-law rules. However, if you are a consumer, nothing in these Terms deprives you of mandatory protections you enjoy under the laws of the place where you normally live, and nothing prevents you from relying on them. Your purchase itself is additionally governed by the checkout terms of our merchant of record.

17. Changes to these Terms

We may update these Terms prospectively. For material changes we will give direct notice (email or in-product) before they take effect, with the effective date stated; if a material change adversely affects your paid plan, you may cancel and receive a prorated refund of any prepaid, undelivered period. Changes do not apply retroactively.

18. General

  • Entire agreement: these Terms, the Acceptable Use Policy, the Refund Policy, and the Privacy Policy are the entire agreement between you and us about the Service, and supersede marketing statements.
  • Severability: if any provision is held unenforceable, it will be modified to the minimum extent necessary, and the rest remains in effect.
  • Survival: sections that by their nature should survive (including licenses needed for content you leave published, accrued refunds, sections 13, 14, and 16) survive termination.
  • Assignment: you may not assign these Terms without our consent; we may assign them as part of a genuine business transfer (including transferring the Service to a company entity), with notice to you and no reduction of your privacy protections.
  • Notices: we send notices to your account email; you send notices to support@powermyweb.com. No waiver of these Terms is effective unless in writing.
